Gas health and safety law and enforcement

Gas health and safety law aims to ensure the safe installation, maintenance and use of gas in domestic and business premises. The Health and Safety Executive is a government agency responsible for the regulation of almost all the risks to health and safety arising from work activity in Britain. The HSE and local authorities have joint enforcement responsibilities under the Gas Safety (Installation and Use) Regulations 1998 which aim to prevent injury to consumers and the public from either carbon monoxide (CO) poisoning or fire and explosion.

The Gas Safe Register is the hallmark for gas safety. This organisation manages the register of gas engineers who are properly and legally qualified to work with gas in Great Britain and the Isle of Man. All Newco Catering engineers are registered with the Gas Safety Register. All gas appliances such as boilers, fires, ovens and hobs should be installed and maintained using a Gas Safe registered engineer.

Gas Safe Register replaced the CORGI gas register on 1 April 2009.

It is against the law for anyone to do work on gas appliances in Great Britain and the Isle of Man unless they are Gas Safe registered.

What are the duties of an employer / landlord in relation to gas safety?

It is important to determine who is responsible for gas safety in your organisation, clarify whether it is landlord or tenant; the terms of the lease usually make this clear.

The responsible party has duties under the Gas Safety (Installation and Use) Regulations 1998 to arrange installation by a Gas Safe Registered engineer for all pipe work, appliances and flues, which they own and have provided for employees / tenants use. They must also arrange for an annual gas safety check to be carried out by a Gas Safe Registered engineer. They must keep a record of the safety check for 2 years and issue a copy of the Gas Safety Certificate to each existing tenant within 28 days of the check being completed and issue a copy to any new tenants before they move in. Failure to comply can result in heavy fines or even a custodial sentence.
